Terms and Conditions
These Terms and Conditions govern access to and use of GougCash as a private closed-loop digital wallet, internal transaction platform, and vault savings environment. By creating a GougCash account, a user agrees to these terms from the date the account is created.
1. Agreement to These Terms
By accessing GougCash, creating an account, verifying an email address, setting up a wallet, or using any GougCash service, the user confirms that they have read, understood, and agreed to these Terms and Conditions. If a user does not agree, that user must not register for or use GougCash.
2. Nature of the Platform
GougCash is a private community transaction platform that operates as a closed-loop USD digital wallet system. Funds may move within the GougCash ecosystem through supported internal wallet functions, including eligible wallet funding, peer-to-peer transfers, payment orders, vault savings features, and other internal balance activities made available by the platform.
GougCash is not a public bank account, not an investment marketplace, not a deposit-taking institution for public banking purposes, not an open exchange, and not a general withdrawal service to external funding sources.
GougCash may allow wallet funding through approved internal or externally initiated top-up methods, but external top-ups are subject to review, verification, approval, delay, or refusal by platform administrators before any wallet credit is applied.
3. Closed-Loop Wallet Restriction
GougCash operates on a closed-loop basis. A user may not use the platform as an external cash-out or withdrawal channel. Funds credited into GougCash are intended for use only within the GougCash ecosystem, including eligible wallet funding, peer-to-peer transfers, payment orders, vault balance movements, and other internal wallet activities made available by the platform.
GougCash reserves the right to restrict, reverse, suspend, or refuse any transaction or account activity that appears designed to defeat the closed-loop nature of the platform.
4. Eligibility and Accurate Information
A user must provide truthful, complete, and accurate information during account registration, wallet setup, recovery requests, profile updates, and all later use of the platform. GougCash may suspend, reject, or close an account if submitted information is false, misleading, inconsistent, duplicated, fraudulent, or no longer reliable.
The user is responsible for maintaining valid email, identification, and contact details on file. GougCash may require re-verification of identity information at any time.
5. Account Creation, Wallet Setup, and User ID
GougCash account access and wallet creation are separate stages. Email verification may be required before wallet creation can proceed. A wallet profile may require identity and security information, including personal details, date of birth, phone number, ID or passport information, a security question answer, and a transaction PIN.
GougCash issues a numeric User ID or account number for wallet use. The user is responsible for storing this identifier safely. GougCash is not liable for avoidable loss, delay, or confusion caused by a user’s failure to retain or protect their User ID.
6. Security Responsibilities
The user must keep login credentials, PIN details, recovery answers, device access, and account notifications confidential. A user must not share authentication credentials with another person or allow another person to operate the account on their behalf without written platform approval.
- The user is responsible for all activity carried out through their account unless GougCash determines otherwise after review.
- The user must notify GougCash promptly if there is any suspected unauthorized access, compromised PIN, identity fraud, or suspicious transaction activity.
- GougCash may require identity checks, account holds, PIN resets, or password resets whenever suspicious access or unusual transaction behavior is detected.
7. Transactions, Fees, and Platform Controls
GougCash may apply a transaction fee to eligible wallet activities, including peer-to-peer transfers. Any active fee rate is a platform setting and may be revised by the platform from time to time. The applicable fee at the moment a transaction is processed will govern that transaction.
A user is responsible for confirming the recipient, amount, reference details, and available balance before confirming a transaction. Once a transaction is processed, GougCash may treat it as final unless reversal, correction, or intervention is required by platform policy, technical necessity, fraud review, dispute handling, compliance, or administrator action.
8. Funding Requests and Manual Verification
GougCash may accept wallet funding requests supported by external proof or external references. Submission of a funding request does not create an automatic right to credit. GougCash may review, reject, delay, verify, request more evidence, or cancel a funding request at its sole discretion.
A wallet credit may only be applied after review by the appropriate platform administrator. GougCash may refuse any funding request that is incomplete, suspicious, unsupported, duplicated, inconsistent with account activity, or otherwise harmful to platform integrity.
9. Payment Orders and Internal Requests
GougCash may permit users to create internal payment order requests. A payment request does not guarantee approval, settlement, or payment. The recipient retains the right to approve or decline an eligible request, and GougCash may also cancel, suspend, expire, or restrict a payment order where necessary for operational, security, or policy reasons.
10. Vault Savings and Commitment Features
GougCash may make available an internal vault savings feature that allows a user to move part of their wallet funds into a vault balance and, where the platform allows, lock that vault balance for a selected commitment period. Vault balances remain part of the GougCash closed-loop ecosystem and do not create an external account, investment certificate, negotiable instrument, or withdrawal right outside the platform.
Where a vault is locked, the user understands that locked vault funds may be restricted from normal wallet movement or spending until the vault matures or is otherwise unlocked through an approved platform flow. Locked vault funds are not treated as freely spendable live wallet balance during the commitment period.
GougCash may permit a user to unlock a vault before maturity subject to platform controls, including PIN confirmation and any applicable early unlock consequences.
11. Vault Earnings, Performance, and No Fixed Return
GougCash may, from time to time, provide a vault earnings feature linked to eligible vault commitment behaviour. Any such earnings are performance-based, variable, discretionary within platform rules, and not fixed, guaranteed, promised, insured, or owed merely because funds were placed into the vault.
GougCash does not promise any specific return, fixed percentage, guaranteed reward, or guaranteed outcome for any vault commitment. The fact that a vault feature exists does not create a promise that a user will always receive earnings, nor does it create a contractual right to any specific earning amount at any given time.
GougCash may revise, suspend, limit, or discontinue vault earning settings, vault earning conditions, or vault earning availability where necessary for platform performance, system integrity, liquidity, security, operational risk, or policy reasons.
12. Early Unlock, Forfeiture, and Penalty Risk
If GougCash permits early unlocking of a vault before the selected commitment period is completed, the user understands that early unlock may affect or remove eligibility for any vault earnings linked to that commitment. GougCash may also apply an early exit penalty where the platform settings so provide at the time of the unlock event.
The applicable early exit penalty, if any, is controlled by current platform settings and may change from time to time. The user is responsible for reviewing vault actions carefully before confirming an early unlock.
13. Prohibited Conduct
A user must not misuse GougCash or attempt to undermine the platform, its data, its liquidity, its audit integrity, or the safety of other users. Prohibited behavior includes, without limitation:
- Using GougCash for unlawful, deceptive, abusive, or fraudulent activity.
- Creating duplicate, fake, misleading, or unauthorized accounts.
- Attempting to bypass internal controls, fees, verification checks, approval flows, balance restrictions, or vault commitment restrictions.
- Using automation, scripts, scraping, reverse engineering, probing, or malicious traffic against GougCash without permission.
- Attempting to exploit bugs, race conditions, API weaknesses, wallet logic, vault flows, administrator workflows, or any platform control path.
- Impersonating another user, administrator, institution, or funding source.
- Using the platform to launder funds, disguise transaction origin, circulate prohibited value, or simulate false activity.
14. Monitoring, Records, and Audit Rights
GougCash may monitor activity, review logs, store notifications, retain transaction history, and preserve audit records for security, fraud prevention, operational analysis, dispute handling, and protection of the platform. GougCash may rely on system logs, audit trails, transaction records, notification records, vault records, and wallet records as evidence of platform activity.
Platform-generated records are presumed accurate unless GougCash determines that a material system error occurred.
15. Suspension, Restriction, Freezing, and Closure
GougCash may suspend, restrict, freeze, deactivate, or close a user account, profile, wallet, vault, transaction, payment order, or funding request at any time where necessary to protect platform security, operational integrity, legal interests, or other users.
- GougCash may freeze balances pending review of fraud, disputes, suspicious activity, technical errors, policy violations, account ownership concerns, or vault-related misuse.
- GougCash may deny reactivation unless the user satisfies requested verification or remediation steps.
- Administrative action may be taken without prior notice where urgent risk exists.
16. Corrections, Reversals, and System Errors
GougCash may investigate and correct technical errors, duplicate credits, unauthorized benefits, misapplied funding, incorrect balance adjustments, incorrect fee application, incorrect vault treatment, accidental reversals, invalid transfers, or any event that threatens the accuracy of wallet balances, vault balances, earning records, or transaction history.
GougCash may debit, credit, reverse, cancel, or hold affected records where reasonably necessary to restore the intended financial state of the platform.
17. No Guarantee of Continuous Availability
GougCash aims to offer real-time wallet processing, vault updates, and notifications, but uninterrupted service, error-free operation, immediate approvals, constant uptime, or constant access are not guaranteed. The platform may be unavailable due to maintenance, upgrades, security events, dependency failures, network issues, or operational controls.
18. Privacy and Data Handling
By using GougCash, the user agrees that GougCash may collect, process, store, and use account, profile, wallet, vault, security, transaction, device, session, and audit data as needed to operate, secure, verify, improve, and enforce the platform.
GougCash may use such data for fraud analysis, account recovery, notifications, account management, transaction review, vault activity review, operational analytics, and enforcement of these Terms and Conditions.
19. Intellectual Property and Platform Rights
All GougCash branding, platform workflows, interface elements, code structure, wallet logic, vault logic, transaction controls, internal tools, text, and design materials remain the property of GougCash or its lawful owner unless expressly stated otherwise. A user may not copy, distribute, modify, reproduce, or commercially exploit any protected platform material without permission.
20. Limitation of Liability
To the fullest extent permitted by applicable law, GougCash shall not be liable for indirect, incidental, consequential, speculative, or special losses, including loss of opportunity, loss of access, loss caused by third-party compromise of the user’s device or credentials, loss caused by inaccurate details submitted by the user, or disappointment arising from variable or unavailable vault earnings.
GougCash’s decisions made in good faith for fraud control, wallet security, transaction review, vault review, funding verification, or system protection shall not of themselves constitute wrongful conduct.
21. Indemnity
The user agrees to indemnify and hold GougCash harmless from claims, losses, liabilities, costs, and reasonable expenses arising from the user’s misuse of the platform, breach of these terms, provision of false information, unlawful conduct, or interference with platform operations.
22. Changes to These Terms
GougCash may revise these Terms and Conditions at any time where required for operations, risk control, legal protection, product changes, security, or policy development. Continued use of GougCash after revised terms are made available will constitute acceptance of the revised terms, unless applicable law requires a different process.
23. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Zimbabwe. In the event of any dispute, claim, or controversy arising out of or relating to GougCash, its services, or these terms, the laws of Zimbabwe shall apply.
Before starting formal proceedings, the user is encouraged to first submit the issue to GougCash through the platform’s support or help channel so that the matter may be reviewed internally.
24. Effective Date of Acceptance
These Terms and Conditions become binding on a user from the date that the user creates a GougCash account. Where a user continues to use GougCash after wallet setup, login, funding submission, transfer activity, payment order activity, vault activity, or security updates, that continued use reaffirms the user’s acceptance of these terms.
